1.  What is the mediation meeting ?

The mediation meeting usually varies depending on the mediator.  Generally, mediations commence with a general session with all parties, counsel and the mediator.  At the general session, there will be a discussion of the case, the issues of the case and other matters important to settlement.   Then the mediator will meet separately with each party and their counsel in separate "caucuses."  In these separate sessions, the mediator will seek to foster negotiations between the parties and develop agreement.

2.  Who is a mediator?

The mediator is typically selected by the parties.  The mediator is usually a lawyer, typically a senior attorney in the area, or a retired judge.

3.  Who pays for the mediator?

The mediator is almost always paid by the parties.  Typically, they split the cost equally.
